After California won in court and the deployment of troops by Trump in Los Angeles tried illegal, Washington, DC, followed by the pursuit of Trump for a deployment of illegal troops in their city.
The DC prosecutor Brian Schwalb posted on X:
DC did not ask or granted the deployment of troops from the National Guard. However, there are 2,300 national guards in our streets in military equipment, carrying weapons and driving armored vehicles. Their deployment to DC violates the law on the rule of domicile promulgated by the congress 52 years ago.
The national guards were deputies by American marshals to perform law application to DC. This includes the power to execute mandates, have people and arrests. Some guards have been ordered to carry firearms and perform armed patrols in residential areas.
The Posse Comitatus Act prohibits soldiers from engaging in domestic police services. However, the administration launched a massive and indefinite operation of the police at DC under direct military command. This is clearly illegal, and it threatens our democracy and our civil freedoms.
There is no clear date of this illegal deployment – more troops arrived at DC this week. An executive decree of August 25 even directs the creation of a DC national guard unit dedicated to “enforce federal law”. And even once the troops leave, they could be redeployed at any time.
Damage to the district is immense. The National Guard units operate without legal authority and without training of the police. They create confusion, are very afraid, erod confidence, ignite tensions and harm the crucial relationship between the police and the communities they serve.
The deployment of the National Guard does not only undermine public security. This also affects the DC economy – depressed vital industries such as restaurants, hotels and tourism. And in a critical way, it undermines the sovereign authority of DC and the right to government autonomy under the law on the interior rule.
We continue to defend DC Home Rule and stop the illegal deployment of the National Guard. Our nation was based on the fundamental principles of freedom and government autonomy which are at stake in this case. No city in America should be subject to involuntary military occupation.
The Trump administration has done such a bad job by implementing this policy that it left legal holes large enough to drive a truck, that even with the unique DC status, the city could gain in court.
Trump greatly exceeded the police in the district and the deployment of the troops of the Armed National Guard. It is contrary to the law for any federal soldier to engage in the application of civil laws on American soil.
California’s decision, which the administration is attractive, provided the reason that other cities and states continue when Trump tries the same tactics.
Trump’s prices were deemed illegal. Deployment of the Trump National Guard to California has been deemed illegal.
Looking at the situation as a whole, it seems that the country and democracy repel, and Trump’s efforts to build a regime could be overturned.
