E. Jean Carroll defeats Trump again while the Court of Appeal rejects the request for presidential immunity

Donald Trump’s net value has more than doubled during the first year of his second term, largely due to the cryptography program he directed, but that prevented Trump from trying to get out of the $ 83.3 million he owes to E. Jean Carroll for having disseminated him.

The judgment is still on appeal by Trump.

On Monday, a federal court of appeal ruled against Trump’s claims according to which its defamation is covered by presidential immunity and that the price in Carroll was excessive.

The Federal Court of Appeal wrote in its decision:

The current appeal comes from the judgment of Carroll I. Although a panel of this court has already rejected the claim of Trump’s presidential immunity, see Carroll v. Trump, 88 F.4TH 418 (2D CIR. 2023) (“Carroll 3”) (Cabranes, J.), Trump now supports that the Supreme Court of the Supreme Court. decision. He also disputes the granting by the district court of partial summary judgment in favor of Carroll, his abolition of his testimony, his instructions on the jury on punitive damages and the size of the compensatory and punitive prices of the jury.

For the reasons set out below, we conclude that Trump has not identified reasons that would justify reconsidering our previous detention on presidential immunity. We also conclude that the District Court did not make any mistakes in any of the disputed decisions and that the prices of damages of the jury are just and reasonable. Consequently, we affirm the judgment of the district court.

The court then spent the following 66 pages of its decision reversing Trump’s arguments.

The courts previously determined that the defamation by Trump of E. Jean Carroll was not an official act of the presidency, it would therefore not be covered by any complaint to presidential immunity.

However, thanks to the conservative majority of the Supreme Court, Trump thinks that he has unlimited immunity, he therefore constantly tries to assert presidential immunity for everything.

E. Jean Carroll is the only private citizen in America who has always been able to defeat Trump. The Carroll affair is the reason why Trump is a rapist tried and wears this label wherever he goes for the rest of his life.
